No appeal on Shelly Bay rejection
The developer of a proposed development planned for Wellington's Shelly Bay says he intends to resubmit an application for a consent under the Special Housing Areas Act.
Ian Cassels from The Wellington Company says he won’t appeal a Court of Appeal decision that Wellington City Council wrongly applied the law when granting consent.
He says seeking a consent through the Resource Management Act would not be financially viable, as the project would have to shrink from 300 to 100 homes to meet the district plan.
While the saga has so far cost him $2 million, he says the loss was greater for the Port Nicholson Block Settlement Trust, which owns most of the land and whose financial future is tied up in the success of the project.
