Authority to appeal Owairaka chainsaw block


Auckland’s Tipuna Maunga Authority has asked the Supreme Court to hear its appeal against a decision limiting its ability to clear exotic trees from Owairaka Mount Albert.
The Court of Appeal this month ruled the authority needed to follow the consultation process laid down in the Reserves Act before going ahead with its plan to revegetate the maunga.
Chair Paul Majurey says the authority needs a decision from the highest court in the land to provide clarity on its co-governance decision-making powers to manage the tūpuna maunga.
He says it’s the first time the courts have been able to consider the powers of a co-governance entity created through a Te Tiriti o Waitangi settlement.
