Ōwairaka trees reprieved


Auckland’s Tupuna Maunga Authority is considering appealing a decision blocking it from removing exotic trees from Ōwairaka Mount Albert.
The Court of Appeal yesterday ruled removal of the trees did not breach the Reserves Act, but the authority had not carried out the necessary consultation and it had to publicly notify its application under the Resource Management Act.
Authority chair Paul Majurey says the decision raises questions as to the relationship between Treaty settlements and the outdated Reserves Act.
He says other councils will review the decision closely to consider the implications on their management of reserves.
