Shelly Bay clears another hurdle
A leader of the group occupying a former defence base beside Wellington Harbour is counting on the Māori Land Court to deliver a better result than the High Court.
Mau Whenua wants the Māori Land Court to overturn the sale of Shelly Bay by Port Nicholson Block Settlement Trust to developer Ian Cassels’ The Wellington Company.
Catherine Love, who was on the trust board when it used the bulk of its treaty settlement cash to buy the land for commercial development, says she’s disappointed the High Court yesterday rejected an application by Enterprise Miramar for a judicial review of the resource consent to build 350 homes and a boutique hotel.
Mau Whenua was not part of the application.
Dr Love says the judgment shows why Mau Whenua needs to look elsewhere.
"They don't consider whānau, hapū, iwi to be beneficial owners of the land and that's a big problem right there because it denies us the right to hold our trustees accountable," she says.
