Ruataniwha ruling to be appealed


The Department of Conservation and the Hawke's Bay Regional Council’s investment arm are making another effort to keep alive an irrigation project that is opposed by Ngati Kahungunu Inc and environmental groups.
They are asking the Supreme Court to overturn a Court of Appeal ruling that stopped the company swapping land needed for the $275 million Ruataniwha Water Storage Scheme.
Andy Pearce, the chair of Hawke's Bay Regional Council Investment Company, says the swap of 170 hectares of private land for 22 hectares of Ruahine Forest Park would provide significant enhancements to the conservation values of the area.
Forest and Bird successfully argued that Conservation director general Lou Sanson did not have the authority to approve the swap.
