The Office of Treaty Settlements says it may be two or three months before it knows whether it will buy land at Marsden Point for a treaty settlement.
In a note to the Waitangi Tribunal, Crown Law said OTS is in talks with Mighty River Power about the two blocks, which are claimed by Patuharakeke.
The hapu is also seeking five other surplus blocks which do not have memorials on the title protecting them from sale.
It wants an urgent hearing about the properties, which the partially-privatised company wants to sell.
