Waiheke marina stoush back to High Court
The High Court has granted the Ngāti Pāoa Trust Board an urgent hearing into its challenge to a Waiheke marina development.
The board says Auckland Council was wrong to engage with the Ngāti Paoa Iwi Trust rather than the trust board during the planning phase, meaning the board was unable to lodge an objection as the tribal authority for Resource Management Act issues.
Justice Simon Moore says it’s a long-running and complex proceeding, but the circumstances merit a priority two-day hearing.
Because Covid restrictions have affected court schedules, that will be scheduled for when the courts reopen for the new year on February 2.
