Dementia surge adds urgency to law review
The Law Commission wants to hear from Māori on its review of the laws around guardianship and enduring powers of attorney.
Lead commissioner Geof Shirtcliffe says the commission wants to consider the involvement of collectives like whanau, hapu or kaupapa Māori organisations when an adult is considered not to have decision making capacity.
A problem with the current laws is they make no reference to the Treaty of Waitangi or tikanga.
“That’s clearly a problem, particularly as this is an area of law where Maori are disproportionately affected – they are experiencing dementia, mate wareware, at a greater rate. Maori and to be able to provide for themselves,” Mr Shirtcliffe says.
Submissions close on June 21.
