Waiheke marine challenge heads for Appeal Court
Ngāti Pāoa Trust Board wants the Court of Appeal to quash the consent for a Waiheke marina.
The trust board says it was the body that should have been consulted on the Kennedy Point Boat Harbour proposal, but Auckland Council ignored its mandate.
Chair Danella Roebeck says it will ask the court for declarations that Auckland Council acted unlawfully and breached its statutory obligations.
She says the Minister of Conservation, Kiritapu Allen, admitted at a public meeting in Waiheke last week that her department let the Waiheke community down by not submitting on the marina resource consent application.
