Mana whenua rights criticism in RMA reform


Tāmaki Makaurau MP elect Peeni Henare says he will fight to protect any gains made by iwi from any changes to the Resource Management Act.
Ngāti Whātua Ōrākei has been jousting in the High Court with other Tāmaki Makaurau iwi about the way they are treated in Resource Management Act consultation.
The Court has ruled the Environment Court can’t rank iwi or determine primary mana whenua, but it can make evidential findings about tikanga based rights where relevant.
Mr Henare says the case needs to be taken into account in any reform.
"Any extinguishing of rights in a new RMA is one of those topics that I'm not prepared to tolerate and we should be pushing hard to make sure those statuses continue into whatever regime might come into place so we will be watching keenly the tribal landscape in Tāmaki Makaurau to make sure the likes of Ngāti Whātua and those who have clear mana whenua here are looked after," he says.
