Tikanga path positive for settlement progress
Tāmaki Makaurau MP Peeni Henare hopes progress can be made on resolving claims in Tāmaki Makaurau now the Supreme Court has allowed a dispute on overlapping claims to go back to the High Court.
Both sides are claiming wins from the appeal, with the Marutuahu Collective Settlement now able to be finalised and Ngāti Whātua Ōrākei saying they can continue to argue their legal rights as mana whenua in the Tāmaki isthmus.
Mr Henare says Tāmaki was always going to be a hotbed of contested interests, but the decision could point the way for other areas as well.
"More and more as people come in to negotiations for their respective tribes, there is a call for a more tikanga-based approach to how tribes and hapu might interact with each other before actually going through the legislative process of settlement. I think that is a good thing because once you lock into that legislative process for settlements, it is always quite hard to draw back from it," he says.
